Important Notes — Directive Principles of State Policy

Overview and Constitutional Basis

The Directive Principles of State Policy (DPSP) are enshrined in Part IV of the Indian Constitution, spanning from Article 36 to Article 51. Borrowed from the Irish Constitution (which in turn copied them from the Spanish Constitution), these principles serve as the guiding philosophy for governance in India.

Core Philosophy

  • Objective: To establish a Welfare State rather than a mere 'police state.'
  • Justiciability: Unlike Fundamental Rights, DPSPs are non-justiciable (Article 37). They are not legally enforceable by the courts for their violation; however, they are fundamental in the governance of the country.
  • Duty of State: It is the duty of the state to apply these principles while making laws.

Classification of Principles

Though the Constitution does not explicitly classify them, they are traditionally categorized by legal experts into three groups based on their ideology:

  • Socialistic Principles: Aimed at providing social and economic justice. Key articles include Article 38 (promote welfare of people), Article 39 (equal pay for equal work), and Article 41 (right to work/public assistance).
  • Gandhian Principles: Reflecting Gandhi’s reconstructive program. Important articles include Article 40 (Organization of Village Panchayats), Article 43 (Promotion of Cottage Industries), and Article 46 (Promotion of educational and economic interests of SCs, STs, and other weaker sections).
  • Liberal-Intellectual Principles: Based on liberal ideology. Examples include Article 44 (Uniform Civil Code), Article 45 (Early childhood care and education), and Article 50 (Separation of judiciary from executive).

Frequently Asked Exam Points

For UPSC, SSC, and state-level competitive exams, students must memorize specific amendments and articles:

  • 42nd Amendment Act, 1976: Added four new principles:

1. Article 39: Healthy development of children.

2. Article 39A: Equal justice and free legal aid.

3. Article 43A: Participation of workers in management of industries.

4. Article 48A: Protection and improvement of environment and safeguarding of forests/wildlife.

  • 44th Amendment Act, 1978: Added Article 38 (2), which mandates that the state shall minimize inequalities in income, status, and facilities.
  • 97th Amendment Act, 2011: Added Article 43B regarding the promotion of Cooperative Societies.
  • Article 51: Mentions the promotion of international peace and security.
  • Conflict with Fundamental Rights: The Supreme Court has established the "Doctrine of Harmonious Construction." The Minerva Mills case (1980) ruled that the Indian Constitution is founded on the "bedrock of the balance" between Part III (Fundamental Rights) and Part IV (DPSP).

Exam Tip: Remember that Article 40 (Panchayats) and Article 44 (Uniform Civil Code) are the most frequently asked articles in competitive exams due to their recurring presence in current affairs and legislative debates.
