Important Notes — Fundamental Duties

Overview of Fundamental Duties

The Fundamental Duties are a set of moral and civic obligations expected from every citizen of India. Incorporated into the Constitution of India to uphold the spirit of patriotism and national unity, these duties serve as a constant reminder that rights and duties are correlative.

  • Constitutional Provision: Added via Part IV-A of the Constitution, consisting of a single article, Article 51A.
  • Origin: Borrowed from the Constitution of the USSR (now Russia).
  • Enactment: Incorporated by the 42nd Constitutional Amendment Act, 1976, on the recommendation of the Swaran Singh Committee.
  • Initial Count: Originally, there were 10 duties.
  • Current Count: The 11th duty was added by the 86th Constitutional Amendment Act, 2002.

List and Nature of Fundamental Duties

The 11 Fundamental Duties listed under Article 51A are:

1. Abide by the Constitution and respect its ideals, institutions, the National Flag, and the National Anthem.

2. Cherish and follow the noble ideals that inspired the national struggle for freedom.

3. Uphold and protect the sovereignty, unity, and integrity of India.

4. Defend the country and render national service when called upon to do so.

5. Promote harmony and the spirit of common brotherhood among all people of India, transcending religious, linguistic, and regional diversities.

6. Value and preserve the rich heritage of our composite culture.

7. Protect and improve the natural environment, including forests, lakes, rivers, and wildlife.

8. Develop the scientific temper, humanism, and the spirit of inquiry and reform.

9. Safeguard public property and abjure violence.

10. Strive towards excellence in all spheres of individual and collective activity.

11. Provide opportunities for education to a child between the age of 6 and 14 years (added by the 86th Amendment Act, 2002).

Important Exam Points for UPSC and SSC

When preparing for competitive exams, aspirants should focus on these critical legal and conceptual aspects:

  • Non-Justiciable: Fundamental Duties are non-justiciable in nature. The Parliament cannot enforce them through judicial courts; however, the state may enforce them through specific legislation.
  • Statutory Implementation: The Verma Committee (1999) identified the existence of legal provisions for the implementation of several Fundamental Duties, such as the Prevention of Insults to National Honour Act (1971).
  • Applicability: These duties are confined only to citizens and do not extend to foreigners.
  • Judicial Interpretation: The Supreme Court often uses Fundamental Duties to determine the constitutionality of a law. If a law seeks to give effect to a duty, it may be considered "reasonable" under Article 14 or Article 19.
  • Key Distinction: Unlike Fundamental Rights, which are enforceable, Fundamental Duties act as a moral code of conduct for citizens.
