Important Notes — Inter-State Relations

Constitutional Provisions for Inter-State Relations

The Indian Constitution incorporates several provisions under Part XI (Articles 261–263) and Part XII to ensure smooth coordination and cooperation between the Center and the States, as well as among the States themselves. These provisions are crucial for maintaining the federal structure of India.

Adjudication of Inter-State Water Disputes

Water management is a primary source of friction between states. To handle this, Article 262 provides:

  • The Parliament may by law provide for the adjudication of any dispute or complaint with respect to the use, distribution, or control of the waters of any inter-state river or river valley.
  • Parliament can exclude the jurisdiction of the Supreme Court or any other court in such disputes.
  • Under this power, Parliament enacted the River Boards Act (1956) and the Inter-State River Water Disputes Act (1956).
  • The Central Government is empowered to establish a Tribunal for the adjudication of specific water disputes.

Inter-State Council (Article 263)

The President is empowered to establish an Inter-State Council to coordinate between the Center and the States.

  • The Sarkaria Commission (1983–1987) strongly recommended the establishment of a permanent Inter-State Council.
  • Consequently, the Council was set up in 1990 through a Presidential Order.
  • Composition: Prime Minister (Chairman), Chief Ministers of all States, Chief Ministers of Union Territories (with Legislative Assemblies), and six Union Cabinet Ministers.
  • Functions: Investigating and discussing subjects of common interest, and making recommendations for better coordination of policy and action.

Zones of Cooperation and Trade

Zonal Councils

Zonal Councils are statutory bodies established by the States Reorganisation Act of 1956. They are not constitutional bodies but function as advisory entities.

  • There are five Zonal Councils (Northern, Central, Eastern, Western, and Southern).
  • The North-Eastern Council was established later by a separate Act of Parliament in 1971.
  • The Union Home Minister acts as the common chairman of all five Zonal Councils.
  • They aim to promote interstate cooperation, resolve disputes, and ensure the successful implementation of development projects.

Freedom of Trade and Commerce

Articles 301–307 in Part XIII of the Constitution deal with trade, commerce, and intercourse within the territory of India.

  • Article 301: Declares that trade, commerce, and intercourse throughout the territory of India shall be free.
  • Article 302: Empowers the Parliament to impose restrictions on the freedom of trade in the "public interest."
  • Article 304: Empowers the State Legislature to impose reasonable restrictions on the freedom of trade or commerce between states, provided they have received the previous sanction of the President.
