Rajya Sabha: Composition and Structural Overview

The Rajya Sabha (Council of States) represents the federal character of the Indian polity. It serves as the Upper House of the Parliament of India, acting as a revising chamber to check hasty legislation.

Constitutional Provisions

  • Article 80: Lays down the maximum strength of the Rajya Sabha as 250.
  • Current Strength: 245 members.
  • Composition:
  • 233 members are elected by the elected members of the State Legislative Assemblies and Union Territories (Delhi, Puducherry, and Jammu & Kashmir).
  • 12 members are nominated by the President of India from individuals possessing special knowledge or practical experience in fields such as literature, science, art, and social service.

Term and Membership

  • Permanent House: The Rajya Sabha is a permanent body and is not subject to dissolution.
  • Tenure: One-third of its members retire every second year. Consequently, a member’s term is 6 years.
  • Eligibility: A candidate must be a citizen of India, at least 30 years of age, and possess qualifications prescribed by the Parliament.

Powers, Functions, and Special Status

While the Rajya Sabha is often termed the "Second Chamber," it holds specific constitutional powers that make it distinct from the Lok Sabha.

Legislative and Special Powers

  • Equal Status: In case of ordinary legislation and Constitutional Amendment Bills, the Rajya Sabha enjoys near-equal powers with the Lok Sabha.
  • Exclusive/Special Powers (Articles 249 and 312):
  • Article 249: The Rajya Sabha can authorize the Parliament to make laws on subjects enumerated in the State List if it passes a resolution by a two-thirds majority in the national interest.
  • Article 312: It can authorize the creation of new All-India Services common to both the Union and the States.
  • Financial Limitations: The Rajya Sabha has restricted powers regarding Money Bills. It cannot reject or amend a Money Bill; it must return the bill within 14 days with recommendations, which the Lok Sabha may or may not accept.

  • Ex-officio Chairman: The Vice-President of India serves as the *ex-officio* Chairman of the Rajya Sabha.
